DCMA Notice

 

1.   Scope.

Nova Technology Holdings, LLC, together with its operating subsidiaries, affiliates, and product brands that post or reference this notice (collectively, the “Company,” “we,” “us,” or “our”), respects the intellectual property rights of others and expects users, customers, and third parties to do the same. This DMCA Notice explains the Company’s process for receiving notices of alleged copyright infringement relating to content made available through the Company’s websites, platforms, software, or related services, and should be read together with the Company’s Terms and Conditions, Legal page, and any applicable customer agreements.

2.   Notice of Claimed Infringement.

If you believe in good faith that any content hosted on, transmitted through, or otherwise made available via the Company’s websites or Services infringes your copyright, you may submit a written notification to the Company’s designated copyright contact. To be effective, the notice should include sufficient detail to allow the Company to identify and evaluate the claim, including the complaining party’s physical or electronic signature; identification of the copyrighted work claimed to have been infringed; identification of the allegedly infringing material and information reasonably sufficient to permit the Company to locate it; the complaining party’s name, address, telephone number, and email address; a statement that the complaining party has a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and a statement, under penalty of perjury, that the information in the notice is accurate and that the complaining party is authorized to act on behalf of the owner of the exclusive right allegedly infringed.

3.  Counter-Notification.

If you believe that content you submitted or made available through the Services was removed, disabled, or restricted as a result of mistake or misidentification, you may submit a written counter-notification to the Company. To be effective, the counter-notification should include your physical or electronic signature; identification of the material that was removed or to which access was disabled and the location at which it appeared before removal or disabling; a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; your name, address, telephone number, and email address; and a statement that you consent to the jurisdiction of the applicable federal court and will accept service of process from the person who submitted the original infringement notice or that person’s agent, as required by applicable law.

 

4.  Company Response and Repeat Infringers.

Upon receipt of a facially valid notice of claimed infringement, the Company reserves the right to remove, disable access to, or restrict the challenged content, to notify the affected user or customer, to request additional information, and to take any other action the Company deems appropriate in accordance with applicable law, its internal policies, and its contractual rights. The Company also reserves the right, in appropriate circumstances and at its discretion, to suspend or terminate the accounts of users or customers who are determined to be repeat infringers or who repeatedly submit or make available content that allegedly infringes the intellectual property rights of others.

5.   Misrepresentations.

Any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability under applicable law. The Company reserves all rights and remedies available in connection with false, abusive, bad-faith, or incomplete infringement notices or counter-notifications.

The Company may update its designated contact information from time to time by posting revised information on its website. If the Company registers a designated DMCA agent with the U.S. Copyright Office, the registered contact information shall also apply.

7. Changes to This DMCA Notice.

The Company may revise this DMCA Notice from time to time to reflect changes in its Services, business operations, legal requirements, or copyright complaint procedures. Any updates will be posted on the applicable website and will become effective as of the revised “Effective Date” stated below. This DMCA Notice is intended to supplement, and not replace, any other rights or procedures set forth in applicable law, the Company’s Terms and Conditions, or other governing agreements.
